We ask that you read and fully understand all details of these terms and conditions in order to fully agree to them. From the moment you log in to the website, you agree to the terms and conditions of this website with no exceptions. Any changes made to this policy will be posted here and your continued use of the site, services and/or software constitutes your agreement to be bound by such changes.
1. Defined Terms
1.1 'The terms ‘www.tutorlearner.com’, ‘us’, and ‘we’ refers to tutorlearner Co., Ltd.
1.2 The term ‘refund’ refers to the repayment of the order amount due to a failure to meet the agreed upon due date
1.3 The term ‘unauthorized transaction’ refers to any transactions that are made which are unauthorized by the credit card/account holder.
1.4 The term ‘error’ refers to operational faults that occur which limit the learner’s access to tutorlearner.com
1.5 The term ‘information’ refers to any data that the user has shared with tutorlearner.com
1.6 'The term ‘fee’ refers to payment or charges made on withdrawal transactions
1.7 The term ‘policy’ and ‘policies’ refers to the policies and agreements between the learner and www.tutorlearner.com
1.8 The term ‘services’ refers to all products, services, and functions planned and offered by the Company
1.9 The term ‘user’ and ‘tutors refers to all persons and entities that are using the services and functions planned and offered by the Company
1.10 The term ‘redemption code’ refers to a term, number, or alphanumerical combination that appears on coupons which can be used by the learners to obtain discounts and other promotional offers
1.11 The term ‘day’ refers to calendar days
1.12 The term ‘business day’ refers any day other than a Saturday or Sunday and any day that are not Thai National holidays
1.13 The term ‘customer service’ refers to support provided by www.tutorlearner.com to ensure learners are receiving high quality service. This support is available at all times and can be reached by contacting hr@tutorlearner.com
2. Copyright infringement of intellectual property
We do not condone copyright infringement of any intellectual property. We expect our tutors to review all information being used in their work to ensure there is no copyright infringement or plagiarism. This includes items such as pictures, videos, audio, research, and any other information that is the intellectual property of others. We will not take any responsibility for any direct or indirect legal issues that may arise due to plagiarism done by any tutor.
3. Work submitted that is declined
If you are unable to complete the work to a satisfactory level due to a lack of skill in the specific area for the order, the system may decline your work and you will not receive any payment for the order. Additionally, if your work is declined, a deduction of $5 from your income balance will be made. (We will use discretion in deciding the right course of action in order to make the best decision.) In order to avoid this situation, we advise our tutors to review the scope of work thoroughly before confirming an order.
4. Limitation of Liability
4.1 Tutors agree that all personal information used to apply to www.tutorlearner.com is accurate and true. If www.tutorlearner.com is made aware of any false information during or after the application, the tutor will be permanently suspended, and we may ask for reparations.
4.2 www.tutorlearner.com is able to ask for confirmation of identify from all tutors which means they would have to provide evidence such as a valid passport, identification card or other legal documents issued by the government that confirm their identity.
4.3 If www.tutorlearner.com is made aware of tutors having more than one account, using another member’s account or trading accounts, we reserve the right to suspend the tutors involved permanently, and we may ask for reparations.
4.4 Tutors are not permitted to give their personal information to our Learners, whether that be their email, phone number or other forms of information. They are not permitted to provide learners with an incentive to hire them outside of our website. If www.tutorlearner.com is made aware of tutors participating in this, we reserve the right to immediately suspend the tutors involved without notice and any remaining income balance in our system will be renounced.
5. Withdrawing your income
The minimum wait for your income to be processed is 15 days, while the maximum is 60 (in circumstances where there a large amount of orders) days after your order is completed. When the ‘Withdraw’ function appears next to an order in the ‘Assignment’ page, it means that your payment has been processed and you are able to withdraw it.
-The ‘Withdraw’ function will appear within 15-65 days, but only if the order has no feedback or re-feeback to be completed. The ‘Withdraw’ function will appear in the ‘Assignment’ page when the income is ready to be withdrawn
-After the ‘Withdraw’ function has appeared, the tutor has 30 days to withdraw the income. . Once the 30 days have expired, the button will appear as ‘Withdraw Expired’. You will no longer be able to withdraw the balance and your income will be renounced.
Note: we will process your withdrawal within 14 days and does not charge any fees in the withdrawal of your income.
6. Work Suspension
If we determine that you are continuously having trouble completing your orders and/or your orders contain errors and mistakes multiple times due to a lack of knowledge and skill on your part, we will deduct your income. If your income is deducted multiple times, we will have to review your status as a tutor, and you may be permanently suspended without prior notice. After suspension, you will be able to withdraw your income balance that is in ‘Your Income’ as stated in the terms of use.
7. Leave of absences and resignations
If you take a leave of absence, you are able to return and work with us with no other conditions or limitations.

9. How to avoid receiving feedback that results in reworks
Receiving feedback for orders could cause multiple issues for our systems, especially for tutors who choose to take on multiple orders. Completing orders that are not satisfactory may lead to multiple reworks which may cause tutors to miss their due dates. Due to this, we advise our tutors to review the scope of work for every order to ensure they are able to complete these orders sufficiently and are able to avoid receiving feedback on their orders that result in reworks. Additionally, when submitting your work, we advise you to check your submission to ensure you provide all information needed for the order to be complete. For each rework, you have a minimum of 3 days for completion. To save as much time as possible, we ask that tutors are diligent in checking their emails, so they are sufficiently notified of any feedback.
10. Making adjustments for orders that receive feedback
If your order is incorrect or incomplete, you must make adjustments according to the feedback received. You will be notified of rework needed by a pop-up window. You must make adjustments and submit it in time with the due date that is agreed upon. The feedback received on your orders can be found on the ‘My Feedback’ page on our website. Feedback is split into two categories as follows:
• Admin Feedback
This is feedback from our admin team after reviewing the work submitted by you. This means that either you have failed to complete all instructions, or the work is not correct. The amount of times admin can give feedback is unlimited.
• Learner Feedback
This is feedback received from our learners. This means that the work submitted is either not complete, not correct or all the instructions are not followed. Learner feedback can be received at a maximum of three times
11. Withdrawing your income
1. Tutors will be able to withdraw their income 15-65 days after the order has been submitted. (This applies to only orders that have been approved)
2. The ‘Withdraw’ function will appear in your ‘Assignment’ page when your income is ready to be withdrawn

12. Plagiarising information from the Internet
If we determine that your work contains more than 1 paragraph (more than 4 sentences) that is copied from the internet without any adjustments, you will not receive any payment. This is plagiarism and will not be tolerated.
